Assumption of Risk I, the undersigned parent or legal guardian of the child named above (the "Child"), acknowledge that participation in the Pit Stop kid-car racing program at Strawberry Village in Mill Valley, California, operated by Marin Moto Ranch, involves inherent and other risks. These risks include, but are not limited to: falls; collisions with other participants, vehicles, cones, barriers, spectators, or fixed objects; mechanical failure of ride-on vehicles; contact with hot or moving parts; exposure to weather, sun, and ambient noise; and other unforeseen risks that may result in property damage, minor or serious bodily injury, or in rare cases, death. I understand these risks cannot be eliminated regardless of the care taken by event staff. I voluntarily allow my Child to participate, and I knowingly and freely assume all such risks, both known and unknown, on behalf of myself and my Child. 2. Release of Liability In exchange for my Child being permitted to participate, I hereby release, waive, discharge, and covenant not to sue Marin Moto Ranch, its owner(s), officers, employees, volunteers, agents, contractors, and affiliated entities, along with Strawberry Village, its property owner and management, event sponsors, and all other parties associated with the event (collectively, the "Released Parties"), from any and all claims, demands, causes of action, damages, losses, or liability of any kind — including those arising from the ordinary negligence of the Released Parties — arising out of or related in any way to my Child's participation in the event, travel to or from the event, or presence on the premises. 3. Indemnification I agree to indemnify, defend, and hold harmless the Released Parties from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) brought by or on behalf of my Child, myself, or any third party arising out of or related to my Child's participation in the event or my Child's conduct at the event. 4. Parental Representations and Responsibilities My Child is within the designated age range for Pit Stop (ages 3–5) and is physically and developmentally able to participate. I will remain on the event premises and will provide direct, line-of-sight supervision of my Child at all times during participation. I have inspected the ride-on vehicle my Child will use (or understand the vehicles provided by Marin Moto Ranch) and accept its condition. My Child will wear a properly fitted helmet at all times while operating a ride-on vehicle. Helmets are required, not optional. I will remove my Child from participation immediately if my Child appears unwell, fatigued, or unable to safely operate the vehicle, or if directed to do so by event staff. 5. Medical Emergency Authorization In the event of a medical emergency where I cannot be immediately reached, I authorize Marin Moto Ranch and its staff to summon emergency medical services and to consent to emergency medical treatment for my Child. I understand that I am financially responsible for any such medical care, and that the Released Parties assume no responsibility for the cost or outcome of that care. 6. Photo and Video Release I grant Marin Moto Ranch and its affiliated partners the irrevocable right to capture and use photographs, video, and audio recordings of my Child taken during the event for promotional, marketing, social media, editorial, and commercial purposes, without compensation. I waive any right to inspect or approve such use. I do NOT consent to photo/video use of my child 7. California Civil Code §1542 Waiver I expressly waive the protections of California Civil Code Section 1542, which provides: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." I understand this waiver applies to claims I do not currently know about, and I accept that risk. 8. Governing Law, Severability, and Entire Agreement This Agreement is governed by the laws of the State of California. Any dispute arising out of or related to this Agreement or my Child's participation in the event shall be brought exclusively in the state or federal courts located in Marin County, California. If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. This Agreement constitutes the entire agreement between the parties regarding its subject matter. 9. Acknowledgment & Signature I have read this entire Agreement carefully. I understand that by signing below, I am giving up substantial legal rights — including the right to sue the Released Parties — on behalf of myself and my Child.
